Terms & Conditions
1. About these terms
These Terms & Conditions explain how we supply products to you through MODA Britain, including goods, services, and digital content where applicable.
Please read these terms carefully before placing an order. They explain who we are, how we provide products, how changes and cancellations work, what to do if there is a problem, and other important information about your purchase.
If you believe there is a mistake in these terms, please contact us before placing your order.
2. About us and how to contact us
MODA Britain is operated in England and has its registered office at:
MODA Britain
Kingdom House
Brunel Road
Newton Abbot
TQ12 4PB
If you need to contact us, please use the contact details provided on our website.
If we need to contact you about your order, we will do so using the email address, telephone number, or postal address you provided when placing your order.
When we refer to “writing” or “written” in these terms, this includes email.
3. Your contract with us
A contract between you and MODA Britain is formed when we confirm acceptance of your order by email.
If we are unable to accept your order, we will let you know and you will not be charged. This may happen if a product is unavailable, incorrectly priced, inaccurately described, or if we are unable to meet a delivery requirement.
We will assign an order number to your purchase. Please quote this whenever you contact us about your order.
Our website is primarily intended for customers in the United Kingdom. If you require delivery outside the UK, please contact us before ordering.
4. Products
We make every effort to ensure that product descriptions, images, and details are accurate. However, products may vary slightly from their photographs due to screen settings, materials, finishes, or production differences.
Product packaging may also vary from the images shown on our website.
Once goods have been fitted, installed, altered, or otherwise used, they may no longer be eligible for return unless faulty or not as described.
5. Changes to your order
If you would like to make a change to an order after it has been placed, please contact us as soon as possible.
If a change is possible, we will let you know whether this affects the price, delivery time, or any other part of your order. If the requested change cannot be made, or if the updated terms are not acceptable to you, you may have the right to cancel in line with the relevant sections below.
6. Changes we may make
We may make minor changes to products where necessary to:
- reflect changes in relevant laws or regulations
- improve the product
- make technical adjustments that do not materially affect its use
If we need to make a more significant change to a product or to these terms, we will notify you. Where appropriate, you may then choose to end the contract before the change takes effect and receive a refund for any goods paid for but not yet received.
Where digital content is supplied, we may update it provided it continues to match the description given before purchase.
7. Delivery and supply
Delivery costs will be shown clearly during checkout.
Estimated delivery times will also be shown during the order process. While we aim to meet all estimated timeframes, delays may occasionally occur due to events outside our control, including courier disruption, weather, or access issues.
If a delay occurs, we will take reasonable steps to inform you where possible and minimise disruption.
Some products may be dispatched separately, particularly where items are fulfilled from different locations. As a result, larger orders may arrive in more than one delivery.
If no one is available to accept delivery and the goods cannot be left safely, the courier may leave instructions for re-delivery or collection. Additional charges may apply where a delivery needs to be rearranged.
Goods become your responsibility once they have been delivered to the address you provided, or once collected by you or a carrier arranged by you.
Ownership of goods passes to you once full payment has been received.
If we need information from you in order to complete your order and you do not provide it within a reasonable time, we may delay or cancel the order.
We may suspend supply of products where necessary for technical, legal, or operational reasons, or if payment has not been made when due.
8. Your right to cancel
You may have the right to cancel your contract depending on what you have purchased, whether there is an issue with the item, and when you decide to cancel.
If a product is faulty, damaged, or not as described, you may have legal rights under consumer law.
If you are cancelling because of something we have done, such as a significant change, pricing error, or substantial delay, you may be entitled to a full refund for goods not yet received.
For most products purchased online, you have the right to change your mind within 14 days of receiving the goods, under the Consumer Contracts Regulations 2013.
However, this right does not apply to certain items, including:
- digital content once download or streaming has begun
- services once fully completed
- sealed items where the seal has been broken for hygiene or health reasons
- goods that have been mixed inseparably with other items after delivery
- items that have been used, fitted, installed, or altered beyond what would be expected when inspecting them
Where goods are delivered in multiple shipments, the 14-day cancellation period begins on the day the final delivery is received.
9. How to cancel and return goods
If you wish to cancel your order, please contact us using the contact details provided on our website.
Please include your name, order number, contact details, and the reason for return where possible.
If goods have already been dispatched or delivered, you must return them to us unless we agree otherwise.
Unless the item is faulty, misdescribed, or being returned due to an error on our part, you are responsible for the cost of return.
Returned items should be unused, in their original packaging where possible, and in a condition suitable for resale.
If you are exercising your right to change your mind, goods must be sent back within 14 days of informing us that you wish to cancel.
Refunds will be made using your original payment method.
We may reduce the refund if the value of the goods has been diminished through handling beyond what would reasonably be permitted in a shop.
Refunds for returned goods will usually be processed within 10 working days of receiving the returned item, or earlier if proof of return is provided where appropriate.
10. Our right to cancel
We may cancel your order or end the contract if:
- you do not make payment when due
- you do not provide information needed to fulfil the order
- you do not allow delivery within a reasonable time
- fulfilment becomes impossible for reasons outside our control
If we cancel your order in these circumstances, we may refund any sums paid for goods not supplied, less any costs reasonably incurred by us.
11. Problems with your order
If there is a problem with your order, please contact us as soon as possible.
If goods arrive damaged, incorrect, or incomplete, you should notify us within 48 hours of delivery.
Where possible, please inspect goods promptly on arrival and keep all packaging until the issue is resolved.
If a product is confirmed to be faulty, damaged, or not as described, we will work with you to provide an appropriate remedy, which may include a replacement, repair, refund, or other solution in line with your legal rights.
Nothing in these terms affects your statutory rights under applicable consumer law, including the Consumer Rights Act 2015.
12. Price and payment
All prices shown on the website include VAT where applicable, unless otherwise stated.
We take reasonable care to ensure pricing is accurate. However, if an obvious pricing error occurs, we reserve the right not to accept the order and to refund any payment already made.
If the rate of VAT changes between your order and the date of supply, we may adjust the VAT applied unless you have already paid in full.
Payment must be made using one of the methods shown on our website.
For goods, payment is taken before dispatch.
For digital content, payment is taken before access or download.
For services, payment may be required before work begins.
If you believe an invoice or charge is incorrect, please contact us promptly.
Additional delivery or re-delivery charges may apply where a delivery attempt fails or special arrangements are required.
13. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these terms or by our failure to use reasonable care and skill.
We do not exclude or limit liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- breach of your legal rights in relation to products
- defective products under applicable law
We are not responsible for losses that are not foreseeable.
We are also not responsible for business losses where products are purchased for commercial, resale, or business use.
You should not arrange installation, fitting, or third-party works until goods have been delivered, checked, and accepted. We are not liable for costs arising from delays, damage, or issues identified after such arrangements have been made without confirming the goods first.
14. Your personal information
Our Privacy Policy explains how we collect, use, and protect your personal information.
We use your information to:
- process and fulfil your order
- take payment
- communicate with you about your purchase
- send information about similar products where permitted by law or where you have consented
You may opt out of marketing communications at any time.
We only share personal information where necessary to fulfil your order, comply with legal obligations, or where otherwise permitted by law.
15. Other important terms
We may transfer our rights and obligations under these terms to another organisation. This will not affect your rights.
You may only transfer your rights or obligations under these terms with our written agreement.
These terms are between you and MODA Britain only. No other person has any right to enforce them.
If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.
If we delay in enforcing any part of these terms, this does not mean we have waived our rights.
These terms are governed by English law. You may bring legal proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland where applicable by law.
16. Online dispute resolution
If applicable, online dispute resolution services may be available to consumers through the relevant European or UK platforms.
